What is your current level of experience in freelance work?
We signed an agreement with a consultant to help us with proposal writing. The contract was front loaded on the retainer as well as having a commission clause, which is now irrelevant. After signing the agreement, the consultant stated an interpretation of the scope of work clause - "proposal shaping" - which essentially meant just giving very minor feedback, and claimed that helping with actual proposal drafting was out of scope. We did not pay the rest of the retainer, and soon after terminated the contract. He has now employed an attorney to bring a case for the remaining balance ($11K now plus some legal fees), and the contract says it must be litigated in Delaware. For now, I'm interested in a quick conversation to understand the landscape and likelihood of success or fees if we proceed to go to court. I envisage this initially being a 30 minute conversation with an attorney who has actual experience of small dispute litigation, ideally in Delaware. It might become more than that depending on what we decide to do next.
