Description: We are seeking a licensed California attorney with experience in consumer protection, supplement labeling violations, and product liability. Our family gave a daily-use supplement powder to a toddler over the course of 18 months. The product packaging featured bold “NO CAFFEINE” labeling. However, we later discovered it contains caffeine ingredients such as dried coffee bean and green tea leaf extract. This led to prolonged health, behavioral, and neurological symptoms in the child before the cause was identified and we stopped giving it to the child. The symptoms went away almost immediately. The company eventually confirmed that trace caffeine is present in the product, despite its continued use of bold “NO CAFFEINE” labeling. We spoke directly with the CEO on two separate occasions. He acknowledged the issue, apologized, and offered a financial settlement, initially proposing $50,000. We countered, and he was open to a larger figure—but he never followed up. To date, the product remains on major retail shelves with no labeling changes, even after being notified of the labeling contradiction and its impact on a toddler. In researching the company, we discovered they appear to have settled a case related to lead contamination or exposure. Out of concern, we our getting ours tested for lead content, in addition to caffeine content. We believe this situation reflects a pattern of neglect or misrepresentation, and are seeking legal guidance on how best to proceed.
