Their phone number has allegedly been registered on the National Do Not Call Registry since 2022. The caller allegedly admitted the call was a cold call. The individual is demanding: Cessation of all future contact. Written confirmation that their number has been removed from our contact list. Statutory damages of $500, or $1,500 if the violation is deemed willful under 47 U.S.C. § 227(c)(5). We are seeking a qualified attorney with experience in TCPA compliance and consumer protection defense to assist with the following: Scope of Work: Review the demand letter and assess the validity of the claims. Investigate potential defenses and determine whether our organization has any liability under the TCPA. Draft a formal response letter to the sender within the specified timeline. Advise us on potential legal exposure and next steps, including negotiation strategy or litigation preparedness. Ideal Candidate: Licensed attorney in the United States with demonstrated experience in TCPA matters and consumer protection law. Familiarity with National Do Not Call Registry rules and FCC enforcement. Experience representing small businesses or organizations facing similar claims. Ability to provide concise, risk-aware legal counsel.
