Visa Worker Questions for Texas Landscaping Business


I'm currently in negotiations to buy a small commercial landscaping business in Texas. The business uses a crew of laborers made up entirely of visa workers, who they say have been extremely loyal for the last 8 years. So what's the problem? The sellers appear to be side-stepping the DOL regulations. They are leveraging the H-2A program, and claiming in their visa applications that these individuals will perform "farm work, planting, etc.". But in reality, these workers are true landscapers who should be under the H-2B visa program. I'm hoping to consult with an immigration expert who understand these laws well and who can help me assess the risk in moving forward with this acquisition. I'll share specific questions later.
