Seeking Expertise in Civil Code for Property Dispute


Background: My father passed away in 2023, leaving behind a 50% ownership stake in a single-family residence located in Louisiana. The remaining 50% was co-owned by his cousin, who passed away in 2024. I now share ownership with a cousin, herein referred to as defendant. I inherited my father’s 50% share through a small succession finalized on February 6, 2025. The defendant acquired his 50% share through a small succession completed on December 6, 2024. I have been negotiating with the defendant without success to sell the property or purchase my portion of the property. Project Description: Given the cost of litigation and expected return on a partition by licitation I am considering proceeding Pro Se. I have received mixed advice when advised by different attorney’s. So, I need to do a deep dive into the process to determine if it’s feasible with no formal training. Once I collect enough information, I can make an informed decision. The first phase of the project is to gather information on the legal process (i.e. statutes, court rules, court documents, process). The second phase, if needed, would be to draft the pleading for submission to the court. Project Deliverables: • Document guidelines and protocols that govern court proceedings in a partition licitation proceeding. • Review and provide feedback on of civil code and civil code of procedures governing property disputes • Identify documents, evidence to support findings in favor of legal partition of the property. • Document legal arguments used by defense to defeat the partition of the property. Skills Needed: • Experience using legal research databases like LexisNexis and Westlaw. • Ability to conduct effective searches and retrieve relevant information. • Accuracy and thoroughness in research and analysis. • Ability to identify errors and inconsistencies in legal documents. • Understanding of legal terminology, procedures, and principles. • Familiarity with civil law. • Knowledge of statutes, regulations, and case law Highly Desirable Skills (not required): • Experience with Louisiana Civil Code and Civil Code of Procedure • Real Estate Law
