My business buys land nationwide. We get our land by reaching out directly to land owners via different marketing sources, inquiring about purchasing their land. We do direct mail, cold calling and Google PPC. I’m looking to add in cold texting but first would like to understand the TCPA laws, and risks. Questions are: 1. We are soliciting to buy something from them, not sell a service. Does that make a difference? 2. Is TCPA a federal statue or do I need to worry about state specific rules in each state we do business in? 3. What are the possible risks? Fines? How much? 4. We manually text each lead rather than using a robo texting platform - does that make a difference? 10DLC registered. 5. Can I be personally liable for any lawsuits or does it stop at the corporation?
